These terms and conditions describe your rights and responsibilities as a “User” of the Indian Culture portal. 

All members including academicians, students, researchers, professionals, administrative staff, novice users, educationally, socially, economically, and physically disadvantaged groups or others who get benefit through this service or related project activities and others, who are visitors to our “Site” are described, for purposes of this document as “Users” of our “Site”.

As a general rule, All “Users” are requested to carefully read the “Terms and Conditions (this document)”. By using and accessing our “Site”, it is deemed that you agree to the “Terms and Conditions”.

Indian Culture Portal and the Ministry of Culture (MoC) reserve the right to make changes to the Indian Culture Portal and these terms and conditions, at any time. If those changes affect your rights or responsibilities, you will be notified through the Indian Culture Portal.

These terms of use supersede and replace any terms and conditions you may have previously accepted governing your use of the Indian Culture Portal. 

Though all efforts have been made to ensure the accuracy and currency of the content on this Portal, the same should not be construed as a statement of law or used for any legal purposes. 

Indian Culture Portal accepts no responsibility concerning the accuracy, completeness, usefulness, or otherwise, of the contents. Users are advised to verify/check any information with the relevant Government department(s) and/or other source(s). Further, they are also advised to obtain any appropriate professional advice before acting on the information provided in the Portal.

In no event will the Government of India or Indian Culture Portal be liable for any expense, loss, or damage including, without limitation, indirect or consequential loss or damage, or any expense, loss, or damage whatsoever arising from the use, or loss of use, of data, arising out of or in connection with the use of this Portal.

Links to other websites that have been included on this Portal are provided for public convenience only. Indian Culture Portal is not responsible for the contents or reliability of linked websites and does not necessarily endorse the views expressed within them. We cannot guarantee the availability of such linked pages at all times.

These terms and conditions shall be governed by and construed under the Indian Laws. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of India.

Guidelines for using the “Site”

“Users” will have to ensure compliance with and are not allowed to modify any legal notices, intellectual property usage terms, and conditions, or any agreements, Terms and Conditions, Privacy, and other policies displayed on this “Site” or presented along with any content displayed on our “Site”. All “Users” will need to ensure adherence to the terms of the License as initiated by the Content Owner. By accessing our “Site”, “Users” declare that the content of the “Site” will be accessed and used for fair or non-infringing use. “Users” also declare that they will not violate any policy, rules, or regulations that will attract any legal liability and action. “Users” are required not to interfere with the work of other “Users” or Indian Culture Portal personnel, servers, or resources. The “Users” are not allowed to disassemble, download the code, or use any means to disturb the functioning of the “Site”. Currently, the use of the Indian Culture Portal “Site” is free of charge, but this policy may change in future.    

Guidelines for accessing the content

All content is displayed or hosted on the Indian Culture Portal “Site”, as received from the respective organisation(s). Indian Culture Portal is not responsible for its quality, completeness, or suitability for your purposes. The content that is displayed, is not created or owned by Indian Culture Portal. The content may be obscure, provocative, limited for use by defined audiences, promotional, offensive, disturbing, weird, misleading, fraudulent, or otherwise objectionable. There may be some content of which usage requires supervision by parents, mentors, and teachers or guardians. “Users” are required to follow the guidelines or directions for usage of the content if any, mentioned by the content owner. Indian Culture Portal will not be liable for any damage caused due to usage without proper directions. “Users” are advised to check the accuracy, completeness, and suitability of the content for their purposes. They are also required to follow the guidelines, legal status, access policy, IP policy, terms and conditions, rules and regulations, and all other information before usage of the content. It is the sole responsibility of the “User” to take all due precautions while accessing such information. Indian Culture Portal may change, add, or remove some content at its discretion and hence does not guarantee uninterrupted, error-free availability of the content.

Cyber security

Indian Culture Portal will follow all standard security protocols and take all reasonable precautions to protect the “Site” from any cyber-attacks. We do not, however, hold out any guarantee (either expressed or implied), that such attacks will never happen. All “Users” are required to ensure that their own devices are safe from any cyber-attack of any kind and any source. We suggest our “Users” take due precautions while downloading or accessing the content. We are not responsible or liable for any damage due to such unexpected events.

Guidelines for usage of the Trademark

Use of “NML”, “National Mission on Libraries”, “Indian Culture Portal”, and its logos, seal, and any variations thereof, is not allowed without prior consent, except for the purposes of attribution as required by our “Creative Commons License, CC BY 4.0”. Any use which indicates, the endorsement by “NML”, “National Mission on Libraries”, “Indian Culture Portal”, or any use for promotion or commercialization, or any such activity which certifies the relationship of “NML”, “National Mission on Libraries”, “Indian Culture Portal”, is prohibited.

Account deactivation

Indian Culture Portal at its sole discretion at any time by written notice (including email or notice on the “Site”) may immediately deactivate any password it has issued, and bar a “User” from access to the “Site”.

Indemnification

“Users” of this “Site” agree to indemnify and hold harmless the “Indian Culture Portal” and its employees, subsidiaries, affiliates, agents, officers, and directors, from and against any liability, loss, claims, damages, expenses (including, but not limited to reasonable legal fee), and/or actions, arising out of related or incidental use of or the inability to use the “Site” contents provided/edited/changed/updated, or resulting from unauthorized usage by the “Users” on this “Site”. Under no circumstances, including, without limitation, negligence, shall the “Indian Culture Portal” or its associates be responsible and liable to “Users” for any direct, indirect, incidental, consequential, special, and exemplary or direct or indirect damages, remote loss/damage of any kind including but not limited to loss of data, loss of goodwill, or other intangibles, loss of revenues, loss of profits, loss of business, loss of opportunities, loss of health, loss of reputation, etc., even if it has been advised of the possibility of such damages.
